1. General
Mag. Martha Tretter performs coaching and consulting according to these General Terms and Conditions (GTC). With the commissioning these terms and conditions are considered accepted. Deviations from these GTC must be agreed upon in writing.
The contracts concluded by me are service contracts, unless explicitly agreed otherwise. The subject of the contract is therefore the provision of the agreed services, not the achievement of a specific result. In particular, Martha Tretter does not owe a certain economic result. The opinions and recommendations prepare the personal decision of the client. They can in no case replace it.
Mag. Martha Tretter is entitled to use assistants, expert third parties and other vicarious agents for the execution of a consulting contract. Consulting services in legal and tax matters are neither promised nor provided by us on the basis of the applicable regulations. These services are to be provided by the client/principal him/herself.
2. offers, fees
The offers are subject to change. Subject to change without notice. All fees are in Euro.
For coaching and consulting services, the fees published on the website and/or specified in the coaching or consulting agreement will be charged. If the coaching or consulting takes place outside of Vienna, additional travel and accommodation costs will be charged within reasonable limits.

As long as there is no confirmation of costs from another source, the client is considered to be the debtor of the coaching or consulting fee.

Pay your own share for funded coaching packages before the first lesson.

My fee, unless otherwise agreed, is due immediately upon invoicing and without deduction. Retention of our fee and offsetting are only permitted if the client’s claims are recognized by me or have been legally established.

3. Cancellation of an appointment
.
Cancellation of the coaching or consulting session free of charge is possible up to 24 hours before the appointment, for Monday appointments until Friday 13.00, after which the fee is due in full. This also applies to the free initial consultation! By making an appointment for the initial consultation, you accept this regulation.

4. Copyright
.
All documents handed over to the client/principal are included in the agreed remuneration, unless otherwise agreed. The copyright to the documents belongs solely to Mag. Martha Tretter. The client is not allowed to reproduce the documents in whole or in part and/or make them accessible to third parties without the written consent of Mag. Martha Tretter.
5. Insurance Coverage

Each client/client bears full responsibility for him/herself and his/her actions inside and outside the coaching sessions and is responsible for any damages caused. Coaching is not psychotherapy and cannot replace it. Participation requires a normal mental and physical resilience.

Organizer of team coaching, seminars, workshops, etc. is always the client/client. Therefore, the participants have no insurance coverage by Mag. Martha Tretter.

6. Liability

The information and advice in coaching sessions as well as in all docu-mentations are carefully considered and checked by the coach. The activity of Mag. Martha Tretter is a pure service activity. Therefore, no success is owed. Liability is excluded. The dispatch or electronic transmission of any data is at the risk of the client.

The liability for the proper performance of the services according to § 1 of the consulting agreement is limited to the partnership and to the respective service provider.

In case of a defective service, Mag. Martha Tretter is entitled to rectify the defect. If the rectification fails twice, the client shall be entitled to the statutory rights.

7. Confidentiality
Mag. Martha Tretter undertakes to maintain unlimited confidentiality vis-à-vis third parties about all operational, business and private matters of the client/principal that become known in the course of the activity, even after the termination of the contract. Furthermore, Mag. Martha Tretter undertakes to carefully store the documents provided for the purpose of the consulting activity and to protect them against inspection by third parties.
8. Duty of the client to cooperate

The coaching is based on the preparatory discussions held between the parties. It is based on cooperation and mutual trust. In this context, the coach would like to draw attention to the fact that coaching is a free, active and self-responsible process and certain successes cannot be guaranteed. The coach stands by the client as a process facilitator and support for decisions and changes – the actual change work is done by the client. The client/principal should therefore be willing and open to engage with him/herself and his/her situation.

9. Final provision

If individual provisions of the contract with the client including these General Terms and Conditions are or become invalid in whole or in part, this shall not affect the validity of the remaining provisions. The wholly or partially invalid provision shall be replaced by a provision whose economic success comes as close as possible to that of the invalid provision.
10. Place of Performance and Jurisdiction
.
The place of performance shall be Vienna
.
The place of jurisdiction is the competent commercial court in Vienna. The law of the Republic of Austria shall apply.
